1. Acceptance of Terms

By accessing or using the website at kasandy.com (the “Site”) or placing an order with Kasandy Inc. (“Kasandy,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site or place an order.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2. About Our Products

Kasandy products are handmade in small batches in our Vancouver studio using natural and organic ingredients. Because our products are handcrafted, minor variations in colour, texture, scent intensity, and appearance are normal and expected — they are not defects. Each product is a genuine handmade item, and no two batches are identical.

Product images on the Site are representative and may not exactly match the appearance of the product you receive due to natural variation, screen colour calibration, and batch differences.

We strive to provide accurate ingredient lists and product descriptions. If you have allergies or skin sensitivities, please review all ingredients listed on the product page before purchasing. Kasandy is not responsible for adverse reactions resulting from an undisclosed pre-existing condition, allergy, or sensitivity that was not communicated to us in advance.

3. Ordering

Placing an order on the Site constitutes an offer to purchase the selected product(s). We reserve the right to accept, decline, or cancel any order at our sole discretion. An order is confirmed only when you receive an order confirmation email from us.

You agree to provide accurate, complete, and current information at the time of purchase, including your name, shipping address, and contact details. Kasandy is not responsible for orders that cannot be delivered due to inaccurate or incomplete information provided by you.

We reserve the right to limit quantities or refuse orders we believe to be placed for resale without a wholesale agreement.

4. Payment

All payments are processed securely through Square, a PCI DSS Level 1 certified payment processor. Kasandy does not store, have access to, or process your payment card information directly. By completing a purchase, you also agree to Square’s terms and conditions.

All prices are displayed and charged in Canadian dollars (CAD) unless otherwise stated. Applicable taxes (GST/HST/PST) will be calculated and displayed at checkout based on your shipping address.

In the event of a pricing error on the Site, we reserve the right to cancel affected orders and issue a full refund, even after an order confirmation has been sent.

5. Order Cancellations

You may request to cancel an order within 24 hours of placing it, provided the order has not yet entered the processing or packing stage. To request a cancellation, please contact us immediately at hello@kasandy.com with your order number.

Once an order has been packed or shipped, it cannot be cancelled. In this case, our standard returns policy applies. Kasandy reserves the right to cancel orders due to stock unavailability, suspected fraud, or errors in pricing, with a full refund issued to the original payment method.

6. Shipping & Returns

7. Intellectual Property

All content on the Site — including but not limited to text, photographs, graphics, logos, product names, brand identity, and the Kasandy name — is the intellectual property of Kasandy Inc. and is protected by applicable Canadian and international copyright and trademark laws.

You may not reproduce, distribute, republish, upload, post, transmit, or modify any content from this Site without our prior written consent, except for personal, non-commercial use. Unauthorized use of our intellectual property may give rise to a claim for damages.

User-submitted content (e.g., reviews, photos tagged with @kasandyinc) grants Kasandy a non-exclusive, royalty-free, worldwide licence to use, display, and share that content for marketing purposes.

8. Prohibited Use

You agree not to use the Site to:

• Violate any applicable local, provincial, national, or international law.
• Transmit any unsolicited advertising, promotional material, or spam.
• Impersonate Kasandy or any person or entity.
• Engage in any conduct that restricts or inhibits any other user’s use of the Site.
• Attempt to gain unauthorized access to any portion of the Site or its related systems.

9. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis without any warranties of any kind, express or implied. Kasandy does not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components.

Our products are intended for general personal use. Nothing on the Site constitutes medical, dermatological, or health advice. If you have a skin condition or health concern, please consult a qualified health professional before use.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Kasandy Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with:

• Your use of or inability to use the Site or any products purchased.
• Any errors or omissions in the Site’s content.
• Unauthorized access to or alteration of your transmissions or data.
• Any third-party conduct or content on or linked from the Site.

In no event shall our total liability to you for all claims arising from these Terms or your use of the Site exceed the amount you paid for the specific order giving rise to the claim.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in that policy.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the courts of British Columbia, Canada. You irrevocably submit to the personal jurisdiction of those courts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed from these Terms. The remaining provisions shall remain in full force and effect.
